  • commercial facilities

  • telecommunications

To be protected by the ADA, one must have a disability. An individual with a disability is defined as an individual who has a physical or mental impairment that substantially limits one or more major life activities. This includes a person who has a history or record of such impairment, or a person who is perceived by others as having such impairment. Major life activities are actions that an average person can perform with little or no difficulty such as:

  • walking
  • breathing
  • seeing
  • hearing
  • speaking
  • learning
  • working

The ADA has the following five titles:

  • Title I - Employment (all Title II employers and private employers with 15 or more employees)
  • Title II - Public Services (state and local government including public school districts and public transportation)
  • Title III - Public Accommodations and Services Operated by Private Entities
  • Title IV - Telecommunications
  • Title V - Miscellaneous Provisions

The following is a brief summary of some of the major requirements contained in the ADA statute.
